A literary work is a work that explains, describes, or narrates a particular subject, theme, or idea through the use of narrative, descriptive, or explanatory text, rather than dialog or dramatic action. Generally, literary works are intended to be read; they are not intended to be performed before an audience.
Before you apply, you should search the USPTO’s trademark database (Trademark Electronic Search System, or TESS) to see if any trademark has already been registered or applied for that is:
- Similar to your trademark
- Used on related products or for related services, and
- Live
A trademark that meets all three criteria will prevent your trademark from being registered because it creates a likelihood of confusion.
Trademark Electronic Search System (TESS). This search engine allows you to search the USPTO’s database of registered trademarks and prior pending applications to find marks that may prevent registration due to a likelihood of confusion refusal.
